Welcome to UseDesktop. By accessing or using our website, Desktop, cloud services, or any related software ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use UseDesktop. By using the Service, you represent that you meet this requirement and have the authority to agree to these Terms.
2. Account & Access
Certain features, including cloud AI models and data synchronization, require a UseDesktop account. You are responsible for maintaining credential confidentiality and all activity under your account.
3. Acceptable Use
You agree to use UseDesktop only for lawful purposes and must not use the Service for illegal, harmful, abusive, unauthorized, exploitative, spam, malware, impersonation, or terms-violating activity.
4. AI & Automation
UseDesktop provides AI-powered automation and evaluation tools that may perform actions on your computer or in controlled task environments. You are solely responsible for supervising and reviewing automated actions, model runs, and their consequences.
5. Workflow Data & Permissions
The Service may capture screen content, application data, user interactions, workflow traces, screenshots, UI states, task definitions, artifacts, labels, verifier results, verifier audits, reward signals, model outputs, evaluation results, dataset packages, and eval reports. You must have appropriate rights and permissions to capture, submit, process, export, publish, or commercialize any workflow data or environment package you provide through the Service.
6. Connected Infrastructure
If you connect Desktop or the UseDesktop app to hosted app features, automation runtimes, cloud execution, model testing, evaluation, training, dataset packaging, or environment packaging infrastructure, you authorize us to process the relevant workflow data and metadata needed to provide those features and any agreed deliverables.
7. Website Analytics
Our public websites, including usedesktop.com, blog.usedesktop.com, docs.usedesktop.com, and evals.usedesktop.com, may use consent-based Google Analytics. Analytics only runs if you accept it in the cookie banner, and declining analytics does not prevent you from using the Service.
8. Shared Content
If you submit content to hosted UseDesktop features, you must own or have rights to share that content, and it must not contain malicious or harmful payloads.
9. Cloud Services
Cloud features are provided on an as-available basis. We may modify, suspend, or discontinue cloud features at any time.
10. AI Training & Data Use
We do not use your personal data, conversations, screen recordings, or agent execution data to train general AI models by default. Workflow data is used for training, evaluation, RL, dataset creation, environment packaging, or model improvement only when enabled by your product settings, explicit opt-in, workspace instruction, or written agreement.
11. Intellectual Property
All software, branding, and content associated with UseDesktop are our intellectual property or used under license. You may not copy, modify, distribute, or create derivative works without written consent.
12. Termination
We may suspend or terminate your access if you violate these Terms or engage in harmful activity. You may delete your account at any time.
13. Disclaimers
The Service is provided as is and as available without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, secure, or that all automation tasks will succeed.
14. Limitation of Liability
To the maximum extent permitted by law, UseDesktop and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.
15. Indemnification
You agree to indemnify and hold harmless UseDesktop from claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the application or via email.
17. Governing Law
These Terms are governed by the laws of the Republic of Korea, without regard to conflict of laws principles.
